JUDGMENT / ORDER

The petitioner obtained admission in B.Tech. Computer Science in the 3rd respondent-College. The petitioner underwent the first year B.Tech. course. The petitioner was unable to continue in the 3rd respondent college and wants to relieve from the college to seek admission elsewhere. The petitioner approached the 3rd respondent for releasing all his documents to pursue the other course in some other institution. The 3rd respondent refused to release the petitioner's documents. Feeling aggrieved by the action of the 3rd respondent, the petitioner has approached this Court. This Court referred the matter to the mediation. Thereafter, the matter is settled between the petitioner and the 3rd respondent. The 3rd respondent prepared to accommodate the petitioner in the B.Tech. Degree Course in Automobile Engineering. This Court sought the views of the University, to which the 3rd respondent college is affiliated to, so as to ascertain whether there is any regulations which disable a candidate from pursuing the course in second year in different branch. The learned Standing Counsel for the respondent- University submits that there are no such regulations governing this issue. However, it is submitted that since the petitioner wants to change in the 3rd Semester, it may not be possible to ascertain whether the petitioner has lost attendance in pursuing the course so as to make him eligible for appearing for the examination. There is no dispute as to the fact that the first two Semesters are common to all the students who have joined the B.Tech course. On the other hand, learned Senior Counsel for the petitioner submits that the petitioner will not have any difficulty in pursuing the B.Tech. Degree course in Automobile Engineering in the 3rd Semester and there is no loss of attendance to him. 2. In the above facts and circumstances, the petitioner shall be permitted to pursue his B.Tech Degree in Automobile Engineering. If any changes are required to be made in the University records, necessary changes shall be made by the University in the relevant records pertaining to the petitioner. The question relating to the attendance for appearing the examination is left open.
The writ petition is disposed of as above.
