Samajik Parivartan Sewa Samiti ... vs Abdul Samad Commissioner Nagar ...

High Court Of Judicature at Allahabad|15 June, 2016

JUDGMENT / ORDER

The petitioner has preferred a Public Interest Litigation (PIL No. 8430 of 2015) wherein a direction was issued to the sole respondent to consider his grievance and pass appropriate order in accordance with law.
It is stated that in spite of the fact that the said order was served on the respondents, it was not complied with. Thus, the petitioner was compelled to file a Contempt Petition (Civil) No.5452 of 2015 which was disposed of on 04.09.2015 by giving a last opportunity to the respondents to comply the order. The court has also recorded its prima-facie satisfaction that a wilful disobedience has been made by the second respondent.
The grievance of the petitioner is that the order of the contempt court dated 04.09.2015 was also served upon the respondents on 23.10.2015, copy whereof is on record as Annexure-13 to the affidavit filed in support of the contempt petition, but no decision has been taken as yet.
Issue notice to the sole respondent returnable on 08.08.2016. He shall appear in person before this Court on the said date. However, in case the order of the Division Bench is complied with before the said date, he need not be present personally but will file an affidavit explaining that why there was delay in complying the order.
List this case on 08.08.2016.
Let a xerox copy of this order be supplied to Sri Aditya Kumar Yadav, learned Standing Counsel without payment of usual charges for compliance and communication.
