THIS PETITION COMING ON FOR PRELIMINARY HEARING THIS DAY, THE COURT MADE THE FOLLOWING:
ORDER 1. Learned Additional Government Advocate takes notice for the respondents.
2. Petitioner appears to espouse the cause of the needy persons who according to it, have been waiting for grant of land, but have not been granted. The grievance of the petitioner also appears to be that Gomala land has been diverted and allotted to the beneficiaries under the Ashraya Scheme.
3. At the outset, it has to be observed that the so-called landless persons who are waiting for grant of land have not come before the Court. This writ petition is not filed by way of Public Interest Litigation to espouse the cause of public. The persons in whose favour the land has been allegedly illegally granted have not been arrayed as party respondents. In view of the same, no relief could be granted to the petitioner.
4. Hence, this writ petition is dismissed reserving liberty to the petitioner and the affected persons to pursue their remedy in accordance with law including by filing a proper writ petition which is maintainable in law.
5. Learned Additional Government Advocate is permitted to file memo of appearance within three weeks from today.
