JUDGMENT / ORDER

Mr.P.Govindarajan, learned Additional Public Prosecutor takes notice on behalf of respondent and by consent of both counsels, the Criminal Original Petition has taken up for final disposal.
2. The grievance expressed by the petitioner is that by the order dated 09.06.2017 passed in Crl.MP.No.1290 of 2017 on the file of Principal District and Sessions Judge, Coimbatore had imposed condition, directing the petitioner to produce one original title deeds to ensure that he does not abscond after the bail was ordered.
3. According to the learned counsel for the petitioner that in obedience to the order passed in C.M.P.No.2743 of 2016 dated 05.11.2016, he had produced one surety before the learned Judicial Magistrate, No.II, Coimbatore and document is under the Court custody.
4. Subsequently, the petitioner had filed modification petition before this Court in Crl.OP No.11493 of 2017 dated 07.07.2017 and by order dated 25.07.2017, this Court had directed to return a original title deed to the petitioner, which was in the custody of Judicial Magistrate, No.II, Coimbatore. However, it was later realized that the original title deed was in the custody of the Principal District Sessions Judge, Coimbatore. Hence, the petitioner has filed the present petition seeking for return of the document from the Principal District and Sessions Judge, Coimbatore.

In view of the limited prayer sought for, earlier order passed in Crl.MP.No.1290 of 2017 on the file of the Principal District and Sessions Judge, Coimbatore is setaside and consequently, the Principal District and Sessions Judge, Coimbatore is directed to return the original Sale Deed that was furnished while executing the surety before the Judicial Magistrate, No.II, Coimbatore, such an exercise shall be completed within a period of one week from the date of receipt of copy of this order.
4. With the above observations, the Criminal Original Petition stands disposed of.
