JUDGMENT / ORDER

The petitioner is aggrieved with Ext.P7 order of the Registering Authority, Kayamkulam; wherein the registration of a vehicle was declined for the reason that alteration made would affect the safety features of the vehicle. Since an appellate remedy is provided as per the Statute, it would be proper that the petitioner be relegated to such appellate remedy were the factual dispute, which the petitioner raises herein, can be looked into. This Court is not inclined to invoke the extraordinary discretionary remedy under Article 226 of the Constitution of India. 2. In such circumstances, the petitioner is relegated to the appellate remedy and it is made clear that this Court has not expressed any opinion on the merits.
Accordingly, the writ petition closed.
