Heard Sri Shambhavi Nandan, learned counsel for the petitioner and Sri Chandan Kumar, learned Standing Counsel for the State.
By means of this writ petition, the petitioner has come to this Court to quash the order dated 5.11.2018 passed by District Appropriate Authority, Pre-conception and Pre-natal Diagnostic Techniques (Prohibition of Sex Selection) Rules, 1996. By the said order, the premises of the petitioner has been seized.
Learned counsel for the petitioner submits that without suspending the licence and without issuing the notice, the registration could not have been cancelled.
Sri Chandan Kumar, learned Standing Counsel submits that petitioner has a remedy of filing an appeal under Rule 19 before the State Authority prescribed under the Rules.
That being the case, the petitioner may file an appeal in accordance with law and if any such an appeal is filed, the same be considered and decided in accordance with law without unnecessary delay.
With the aforesaid observation, the writ petition is finally
disposed of.
