The applicant is a convict-prisoner, who has filed the present application for extension of period of temporary bail granted to him by this Court by order dated 23.12.2011 passed in Criminal Miscellaneous Application No.17447 of 2011. Under the said order, the applicant was released on temporary bail for a period of three weeks, which gets over on 21.01.2012.
The applicant appeared as party-in-person and submitted that the construction of his house for which he was released on bail under the aforementioned order is still incomplete and that labourers are not available. He stated that the material is lying and half of repairing work is yet to be done. The applicant has produced photograph and certificate of Sarpanch of the village in support of his say.
The applicant is 60 years of age and has spent almost eight years in jail so far. In the circumstances, when the applicant wants to complete the construction work of his house, which he has already undertaken, we deem it proper to extend his temporary bail period for further period of thirty days on the same terms and conditions imposed in the order dated 23.12.2011 referred to above. During the extended period of temporary bail, the same terms and conditions shall govern and the applicant shall abide by the same. There may not be further extension on this very ground for the applicant.
The present application is accordingly allowed. Rule is made absolute.
