Heard Sri Ram Raj Pandey, learned counsel for the applicants and Sri Amit Sinha, learned A.G.A. for the respondent-State.
This application under Section 482 Cr. P.C has been filed by the applicants, seeking stay of the proceeding of Section 82 of Cr PC passed by the Chief Judicial Magistrate, Baghpat on 25.4.2019 in Case Crime No.1478 of 2018 under Section 323, 504, 307, 395, 427 of IPC, Police Station Baghpat, District Baghpat.
After arguing the matter for some time, learned counsel for the applicants wants to withdraw this application with liberty to file regular application seeking bail before the trial Court. He submits that a direction may be issued to the trial Court to decide the bail application expeditiously, so that the applicants may not suffer any further injury.
State counsel, however, submits that discretion be given to the trial Court to decide the bail application in accordance with law.
This application is accordingly, dismissed, as withdrawn with the aforesaid liberty.
Needless to state that in the eventuality of filing any such application, the competent Court shall decide the same strictly in accordance with law.
