The instant anticipatory bail application has been filed with a prayer to grant an anticipatory bail to the applicant, Salman, in Case Crime No. 61 of 2020, under Sections- 3/5A/8 of U.P. Prevention of Cow Slaughter Act, 1955 and Sections 3/11 of Prevention of Cruelty to Animals Act, 1960, Police Station- Singhawali Aheer, District- Baghpat.
Prior notice of this bail application was served in the office of Government Advocate and as per Chapter XVIII, Rule 18 of the Allahabad High Court Rules and as per direction dated 20.11.2020 of this Court in Criminal Misc. Anticipatory Bail Application U/S 438 Cr.P.C. No. 8072 of 2020, Govind Mishra @ Chhotu Versus State of U.P., hence, this anticipatory bail application is being heard. Grant of further time to the learned A.G.A as per Section 438 (3) Cr.P.C. (U.P. Amendment) is not required.
The applicant has been implicated on the allegations of commission of offence under U.P. Prevention of Cow Slaughter Act, 1955. He was arrested and sent to jail. On account of spread of first wave of novel coronavirus, the applicant was enlarged on interim bail by the jail authorities. Thereafter, he got implicated in 4 more cases. He has not surrendered as yet and has approached this Court after grant of interim bail after submission of charge-sheet.
This Court finds that it is not a fit case for grant of anticipatory bail.
This anticipatory application is accordingly, rejected.
