Heard learned counsel for the petitioner and Sri D.K. Tripathi holding brief of Sri Suresh Chandra Tripathi, learned counsel for the respondents.
Present petition has been filed seeking quashing of the impugned order dated 20.01.2017 passed by Up-Ziladhikari Shahganj, District- Jaunpur.
The pleadings have been exchanged between the parties. Present petition is being disposed of at this stage.
At the very outset, learned counsel for contesting respondents no. 6 and 7 states that the impugned order passed under Section 67(4) of U.P. Revenue Code, 2006 and therefore, the petitioner has remedy of filing appeal before the Collector under Section 67(5) of the Code.
Accordingly, present petition stands disposed of with liberty to petitioner to avail the aforesaid alternative remedy. In case the appeal if filed within 15 days, the same shall be considered and decided within one month from the date of filing of such application.
It is made clear that this Court has not examined the claim of the respective parties and the same shall be decided by the authority concerned on its own merits.
