Heard Sri Narendra Singh, learned counsel for the applicant as well as learned A.G.A. for the State and perused the record.
The instant application has been filed by the applicant with a prayer to direct the court of learned District Judge, Allahabad to reconstruct the file of Case No. 1006 of 2014 (Salman Haider Educational & Charitable Trust Chairman Vs. Yogesh Kumar Tiwari) under Section 138 N.I. Act, Police Station-Cantt., District Allahabad, pending before learned Special Judge, N.I. Act, Court No. 2, Allahabad.
Considering the prayer made by learned counsel for the applicant, this Court do not consider it necessary to issue notice to opposite party no. 2 at this stage.
Learned A.G.A. has also no objection if this case is disposed of at this stage.
In the interest of justice, the court below is directed to reconstruct the file of case no. 1006 of 2014 (Salman Haider Educational & Charitable Trust Chairman Vs. Yogesh Kumar Tiwari) after taking photo stat copy from the applicant-Salman Haider and proceed in the matter in accordance with law after giving notice to all the concerned parties.
With the aforesaid observation, this application is finally disposed of.
