JUDGMENT / ORDER

The petitioner is aggrieved with the settlement of timings scheduled, to revise the timings settled on the petitioner, in a timing conference held on 25.06.2014. 2. The learned Government Pleader, on instruction, submits that Ext.P2 notice of timing conference was issued only because two rival operators had objected to the revision of timings granted to the petitioner on 25.06.2014. It is trite that the authority has no power to review and if the rival operators have any objection to the timings settled in favour of a stage carriage operator, such objections have to be agitated in a properly filed revision under the Kerala Motor Vehicles Act, 1988. In such circumstance, there shall be no further proceedings initiated as per Ext.P2. But, however, the rights of the rival operators to move the State Transport Appellate Tribunal is reserved.
Writ petition allowed.
