ORDER:
This Writ Petition is filed for a Mandamus to set aside proceedings in Rc.No.2824/2014-B, dated 22.07.2014, of respondent No.2, whereby he has kept the petitioner’s Fair Price shop authorization under suspension pending enquiry.
As the two charges, on which the authorization of the petitioner has been suspended, are frivolous and flimsy, for the reason that the variations are well within the permissible limits as per Clause 24 of the Andhra Pradesh State Public Distribution System (Control) Order, 2008, this Court has issued a show cause notice to respondent No.2 to explain why disciplinary action shall not be directed to be taken against him.
Today at the hearing, respondent No.2, who is personally present, has placed before the Court the proceedings in Rc.No.2824/2014-B, dated 10.12.2014, whereby he has restored the petitioner’s authorization. It is ironical to notice from the order that respondent No.2 has purportedly let off the petitioner with a warning to be careful in distribution of essential commodities to the cardholders in future. Indeed, respondent No.2 needs such a warning to be careful in future by not resorting to the action of suspension of authorization of the Fair Price shop dealers on non-existent grounds, such as the ones mentioned in the impugned order. As respondent No.2 has submitted to the Court that he has realized that his conduct in suspending the petitioner’s authorization is not proper and he has assured that he will be careful in future, the further contemplated action against respondent No.2 is dropped.
The Writ Petition is, accordingly, closed.
As a sequel, WPMP.No.47813 of 2014 filed by the petitioner for interim relief stands disposed of as infructuous.
