The petitioner when confronted with the objection by the State that an appeal is provided, he has requested that as the period for appeal may have been over, he may be permitted to withdraw the writ petition with liberty to move the appellate authority.
The request, being just and proper, is granted and the writ petition is dismissed as withdrawn.
Appeal be preferred within 4 weeks from today with the delay condonation, if any, the authority concerned shall consider the case on its own merit. If the appeal is preferred along with stay application, it goes without saying that the authority will consider the stay application also.
