The petitioner is the owner in possession of an extent of 10.85 Ares of property in Azhiyoor Village, Azhiyoor Panchayat which according to the petitioner is garden land. The petitioner sought for the issue of a building permit to construct a residential building in the property. The same was rejected by Exhibit P2. The petitioner has therefore submitted Exhibit P3 to the first respondent. The petitioner seeks the issue of appropriate directions for the consideration of Exhibit P3. It is submitted that pursuant to Exhibits P3, Exhibit P4 report has been submitted by the Village Officer. 2. Advocate Lakshmi Narayanan appears for the second respondent.
3. Heard. Since Exhibit P2 is pending consideration of the second respondent, it is only appropriate that, the W.P.(C) No.18197 of 2014-Y -:2:-
same is disposed of without further delay.
This writ petition is therefore disposed of directing the first respondent to consider Exhibit P3 application submitted by the petitioner in the light of Exhibit P4 report of the Village Officer as well as the decisions of this Court, to be made available by the petitioner and to pass appropriate orders in the matter, as expeditiously as possible and at any rate within a period of one month of the date of receipt of a copy of this judgment.
