Heard learned counsel for the petitioner as well as learned Standing Counsel appearing for the State respondents and Sri Azad Rai, learned counsel for the gaon sabha and perused the record.
Present petition has been filed with a prayer to direct the Sub Divisional Officer, Handia, Allahabad (respondent no. 5) to decide the Case No. T20150203044910 of 2015 (Mohd. Slam vs. Ali Hasan and others) filed under Section 176 of UPZA and LR Act within a time bound period.
In the facts and circumstances of the case, the present petition is finally disposed of with the direction to the Sub Divisional Officer, Handia, Allahabad (respondent no. 5) to expedite the hearing of the aforesaid case and decide the same on its own merit, in accordance with law, expeditiously preferably within a period of nine months from the date of production of a self verified copy of this order and no unnecessary adjournments shall be granted to the parties provided there is no legal impediment as well as the functioning of the court is not affected by any reason related to COVID-19 Pandemic as well as the lawyers are not abstaining from the judicial work.
With the aforesaid observations/ directions, the present petition is finally disposed of.
