Heard Shri Irfanul Huda, learned counsel for petitioner and learned A.G.A. for State of Uttar Pradesh.
This writ petition has been filed for quashing the F.I.R. dated 25.10.2018 registered as Case Crime No. 1436 of 2018, under Sections 386 and 507 I.P.C., Police Station- Kotwali City, District- Bulandshahar.
Counsel for the petitioner submitted that petitioner is witness in the case registered against the first infomrant and now allegation is being made against the petitioner. In the F.I.R., it is alleged that petitioner is demanding Rs. 2 lac from the informant who has already accused in a criminal case.
In the facts of the case, this writ petition is disposed of with the direction that petitioner shall not be arrested in Case Crime No. 1436 of 2018, under Sections 386 and 507 I.P.C., Police Station- Kotwali City, District- Bulandshahar till the submission of report by Investigating Officer under Section 173(2) Cr.P.C.
