JUDGMENT / ORDER

The petitioner has approached this Court aggrieved by Ext.P3 notice issued by the second respondent. It is found that the petitioner is operating an industrial unit without obtaining consent from the second respondent. The action has been taken at the instance of the neighbouring owners of the unit. Therefore, if the petitioner approaches the Pollution Control Board for obtaining consent within ten days, the Pollution Control Board shall take appropriate decision to bring the unit's operation without any pollution within a further period of four weeks. Till then, no coercive action shall be taken against the petitioner pursuant to Ext.P3. However, if the petitioner fails to apply for consent or the Pollution Control Board refused to issue consent, the Pollution Control Board is W.P.(C) No.27915 of 2014 2 free to take action against the petitioner. Till a final decision is taken by the Pollution Control Board, the local authority shall not take action against the petitioner. Needful shall be done within an outer limit of six weeks.
The writ petition is disposed of as above.
