Saleema Beevi vs Razia

High Court Of Kerala|22 May, 2014
|

JUDGMENT / ORDER

Manjula Chellur, C.J.
Petitioner's grievance seems to be the obstruction by party respondents to complete the compound wall so far as property of the petitioner situated in Sarkara Village, Thiruvananthapuram District in respect of western and eastern side.
2. Already a judgment and decree granting permanent injunction in favour of petitioner against party respondents herein is obtained from Munsiff's Court, Attingal in O.S. No.129 of 2013. If there is any violation of injunction order, petitioner must approach the court concerned seeking suitable relief.
3. Having regard to the fact that entire dispute revolves round civil rights of the parties, unless any crime is attempted or committed, Police should not intervene in the said civil rights.
With the above observation, the Writ Petition is closed.
Manjula Chellur, Chief Justice.
ttb/22/05 P.V. Asha, Judge.
