By way of the instant appeal, challenge has been made to the judgment and order dated 23.02.2018 passed by the Workmen's Compensation Commissioner / Deputy Labour Commissioner, Meerut Region, Meerut in W.C. Case No.125 of 2010, Saleem Vs. Smt Seema and another, whereby claim petition of the appellant Saleem has been dismissed with the observation that no worthy paper exists on record which may indicate that the appellant himself was involved in the accident and he sustained injury as helper/conductor of the truck concerned.
The view so drawn by Workmen's Compensation Commissioner in its award is based on material on record. It was incumbent on the claimant to have brought paper before the Workmen's Compensation Commissioner his identity as such, as reflected from the relevant papers, which he failed to do so not only before Workmen's Compensation Commissioner but also before this Court. Thus, it is obvious that proceeding drawn between the parties appears to be collusive.
For the reasons aforesaid, the instant appeal lacks merit and the same is dismissed.
