Heard Shri Anil Kumar Ojha, learned counsel for petitioner and Shri Indrajeet Singh Yadav, learned A.G.A. appearing on behalf of State.
This writ petition has been filed challenging the F.I.R. dated 07.05.2018 giving rise to Case Crime No. 536 of 2018, under Sections 420, 467, 468, 471, 406, 370 I.P.C., Police Station- Vijay Nagar, District- Ghaziabad.
The case against the petitioner is that upon a memo received by Government of India in the Ministry of Home Affairs regarding Human Trafficking of Indian Nationals to Kuwait by Shri Salim Malik, an inquiry was undertaken and it was found that the petitioner was engaged in the business of sending out adult Indians to Muslim countries for the purpose of employment there. During the course of inquiry, it was found that a number of these persons were cheated and a group of them who were dropped at the air port had to return home with their VISA rejected. On the basis of that inquiry, the present F.I.R. has been lodged by Laxmi Singh Chauhan, Station House Officer, Police Station- Vijay Nagar, District- Ghaziabad.
The allegations prima facie are very serious and are such that they cannot at all to be interfered within in exercise of power under Article 226 of the Constitution.
Accordingly, this writ petition is dismissed.
