Salar Baig vs M.G.Ravi

Madras High Court|25 January, 2017

JUDGMENT / ORDER

The revision petitioners are the defendants. The revision is filed praying for a direction to direct the learned Subordinate Judge, Vellore to dispose of the suit in O.S.No.112 of 2005 pending on its file.
2. Heard both sides.
3. From the perusal of the typed set of papers, it is seen that the suit has been filed by the respondent/plaintiff for recovery of money based on the promissory note during the year 2005. It is stated by the petitioners/defendants that though they are regular in their appearance before the Court below, the respondent is dragging on the matter for the past one decade. It is alleged that the respondent is filing applications after applications for one reason or another and two such applications filed in I.A.Nos.848 of 2011 and I.A.No.185 of 2013 are still pending consideration by the court below. It is further stated that issues also have been framed and the matter was posted for hearing on 04.12.2013 and on 26.02.2014 and however, till date there was no progress in the suit.
4. Considering the fact that it is only a money suit and that the the matter is pending for the past more than 12 years, the parties are directed to co-operate for the early disposal of the matter. The learned trial Judge is also directed to dispose of the pending applications in I.A.Nos.848 of 2011 and I.A.No.185 of 2013 at the earliest, complete the trial and dispose of the suit itself on or before 30.04.2017, without seeking further extension of time.
5. With the above direction, this Civil Revision Petition is disposed of. No costs.
