Petitioner is police constable in U.P. Police. He has been transferred from Allahabad to Kaushambi. On account of some personal difficulties he wants to retain the official accommodation. In this connection his application has been rejected by the order dated 1.5.2010.
The submission of the learned counsel for the petitioner is that the aforesaid order is unreasoned and it does not take into account the personal difficulties. Petitioner in this connection has again submitted a fresh representation dated 28.5.2010 annexure 7 to the writ petition.
In view of the fact that the order dated 1.5.2010 is uninformed by reasons, the order impugned can not be sustained under law. Learned Standing counsel at this stage submits that the matter be relegated to the authority concerned for deciding afresh in according with law.
In view of the aforesaid, the writ petition is disposed of finally with the consent of the parties. The order dated 1.5.2010 is quashed and direction is issued to the authority concerned to decide the matter afresh in the light of petitioner's representation dated 28.5.2010 by a speaking order in accordance with law as expeditiously as possible preferably within one month from the date of production of the certified copy of this order.
Petition disposed of.
