~ ~ ~ ~ ~ ~ Petition filed under Section 439 Cr.P.C. 2. Petitioner is the 2nd accused in Crime No.384/2013 of Vidyanagar Police Station registered for the offences punishable under Section 20 (b) (ii) (C) of the Narcotic Drugs and Psychotropic Substances Act, 1985.

The allegation against the petitioner and the other accused is that on 17.06.2013 at 6.15 p.m. they were found transporting 77.5 Kgs of ganja brought from the State of Andra Pradesh by lorry bearing registration No.KL.14N.2016 at Paddy Gramam, Athrukuzhy, Kasaragod. The petitioner was arrested on 02.07.2014.
4. Heard learned counsel for the petitioner and the learned Public Prosecutor.
5. This is a case in which the contraband involved is BA.7298/2014.

of commercial quantity. It is true that A1 was enlarged on bail in this case. At the same time, it could be seen that A1 was enlarged on bail under Section 167(2) Cr.P.C. The investigation of this case is not over. The source from where the ganja was obtained could not be traced out so far. The contents of the CD, prima facie, reveal the complicity of the petitioner. Considering all the above, I am of the view that the petitioner is not entitled to be enlarged on bail.
In the result, this Bail Application is dismissed.
