Heard Sri Amit Saxena, learned Senior Advocate assisted by Sri Ram Kaushik and Sri Rajat Khatri, learned counsel for the petitioner, learned Standing Counsel and perused the record.
The present writ petition has been filed directing the respondent no.3 not to terminate the lease deed dated 28.08.2006/11.09.2006 executed in favour of the petitioner, and for quashing of the show cause notice dated 27.05.2021 and the letter dated 07.07.2021 by which the respondent No.3 has granted twenty days time till 27.07.2021 to the petitioner to complete the construction.
In response to the petitioner's letter dated 01.07.2021, the respondent authority granted time of only 20 days till 27.07.2021 to make the unit functional that too on a payment of heavy cost, failing which it may take action according to the terms and conditions as laid down in the allotment letter and the lease deed.
We have been informed that the period of one year for raising construction has to be counted from the date of issuance of the notice in view of the Government Order dated 30th July, 2021. The relevant direction in clause 3 of the Government Order are to be extracted hereunder:-

उक एक वरर कक अवधध कक गणनक आवसनटयय कर वयनकगत नरनटस नदयझ जकनझ कक नतधथ सझ मकनह जकयझ।"
It is submitted by Sri Kaushalendra Nath Singh, the counsel for the respondent authority that the respondent proposes to recall the communication dated 07.07.2021 and modify the time given in the notice dated 27.05.2021 for a period of one year in view of the amendment in the Uttar Pradesh Industrial Area Development (Amendment) Act, 2020 as noted above.
In the said scenario, the cause of action for filing the present petition does not survive.
The writ petition is accordingly, disposed of.
