Present Civil Application has been preferred by the applicants herein original defendants for interim relief to stay the further implementation and operation of the impugned judgment and decree passed by the learned Additional District Judge, Navsari dated 14th October 2011 passed in Regular Civil Appeal No.55 of 2002.
Shri Dakshesh Mehta, learned advocate for the applicants has stated at the bar that in the facts and circumstances of the case if the main Second Appeal is fixed for final hearing at the earliest he does not press the present application at this stage. He has submitted that he will supply the paper book within a period of two weeks from today. In view of the above, present Civil Application is dismissed as not pressed at this stage. In the facts and circumstances of the case, Registry is directed to notify the main Second Appeal for final hearing on 16.4.2012 without fail. Registry is directed to call for the Records and Proceedings from the learned trial Court so as to reach this Court on or before 3rd April 2012. Rule is discharged.
