Heard learned counsel for the petitioner, learned Standing Counsel, Sri Sanjay Kaushik, learned counsel for respondents no. 4 and 6 and Sri S.P. Mishra, learned counsel for respondent no. 3.
The present writ petition has been preferred with the prayer to issue a writ, order or direction in the nature of certiorari to quash the impugned order dated 10.08.2017, passed by the learned District Judge, Amroha and the order dated 27.01.2016, passed by the respondent no. 21 (Annexures 5 and 3 respectively to the writ petition).
By the impugned order, the application of the petitioner which was filed taking an objection that the election petition is liable to be dismissed for non impleadment of the necessary parties, was rejected.
Now along with counter affidavit, a copy of the order dated 05.02.2018, passed by the Sub Divisional Officer/Prescribed Authority has been annexed. It is a photocopy of the certified copy duly supported by an affidavit to indicate that the election petition has been dismissed.
In such view of the matter, the present writ petition has become infructuous.
Accordingly the writ petition is dismissed as infructuous. Interim order, if any, stands vacated.
