JUDGMENT / ORDER

The counter petitioner in M.C.No.15/2012 on the file of the Family Court, Thodupuzha is the revision petitioner herein. The first respondent filed an application for maintenance under section 125 of the Code of Criminal Procedure and after evidence, the family court directed the petitioner herein to pay maintenance at the rate of Rs.3,500/- per month from the date of the order and that order was challenged by filing the revision. During the pendency of this petition, at the request of the parties, the matter has been referred for mediation and the matter has been settled in the mediation and the mediation agreement has been sent to this Court. 2. When the revision petition came up for hearing today, the counsel for the revision petitioner submitted that as per the terms of the mediation agreement, a joint petition for divorce has been filed and the mediation agreement can be recorded and he may be permitted to withdraw the revision.
So permission is granted to the revision petitioner to withdraw the revision petition and mediation agreement is recorded as part of this order and if the terms of the settlement is not complied with as mentioned in the mediation agreement, the first respondent is entitled to proceed with CMP.No.17/20014 in M.C.No.15/2012 pending before the Family Court, Thodupzha.
With the above observations, the revision petition is dismissed as withdrawn. The mediation agreement is formed part of this judgment.
