Heard Sri S.R.Yadav, learned counsel for the petitioner, Sri S.N.Mishra, learned A.G.A. for the State and perused the impugned FIR as well as material brought on record.
This petition has been filed by the petitioners with a prayer to direct the respondent authorities to lodge the FIR against the accused according to version of complainant of the petitioner and conduct fair investigation.
It has been contended by learned counsel for the petitioner that the petitioner had given a report to the concerned police station narrating the incident which had happened with her but the respondent no.5 after reading the complaint, torn it and thrown the same and did not register the FIR for the the actual offence but registered the same for the offence under Sections 323 and 506 only. He further argued that though the victim sustained fracture in his leg, copy of injury report as well as X-ray report has been annexed as Annexure-4 to the writ petition and the FIR should have been registered for the offence under Section 325.
Considering the facts and circumstances of the case and submissions advanced by learned counsel for the parties, it is directed that S.S.P., Etah shall into the matter and get the matter enquired into and ensure that the investigation of the case be concluded expeditiously preferably within a period of eight months from the date of production of a certified copy of this order.
With the above directions this petition is finally disposed of.
