Apprehending arrest in connection with Crime No.899/2014 of Vakathanam Police Station, Kottayam District registered for offences under Sections 447, 341, 323, 354(A),1 (i) & IV of IPC, the petitioner has invoked the remedy under Section 438 of the Cr.P.C for anticipatory bail. When the mater was taken up for consideration today, the learned Public Prosecutor fairly submitted that the aforementioned Sections mentioned in the crime are bailable offences and that the invocation of the remedy conferred under Section 438 Cr.P.C, which is made for non-bailable offence, does not arise for consideration.
In this view of the matter the application for anticipatory bail is closed reserving the liberty of the petitioner to invoke the appropriate remedy in accordance with law.
