Learned counsel for the petitioners would submit that the entries recorded in the revenue record along with the names of the petitioners had basis on the pedigree submitted by the petitioners and so recorded by the TalaticumMantri and the appeals filed against such recording of entries came to be rejected by the Deputy Collector and further appeal is pending before the Collector where no order is passed, and, at the same time, a civil suit is filed seeking a declaration about the correct lineage as descendants of the original owner of the property.
In the backdrop of the factual scenario, a case is made out to issue notice and to grant an adinterim relief.
Issue notice returnable on 13.3.2012. Adinterim relief in terms of paragraph 8(C). Learned APP waives service on behalf of the State. Direct service is permitted qua the private respondent.
