(Per : HONOURABLE MR.JUSTICE JAYANT PATEL) It has been stated on behalf of the respondent by the learned APP that the respondent himself has decided to hold the inquiry and the petitioner was called to give the statement, which was responded by her stating that she would give statement only after her lawyer was available.
Mr.Sutar for the petitioner states that the father of the petitioner, Shri Sirajbhai Abdulbhai Vora, will go with the lawyer for giving the statement before the officer on 14.11.2011.
The statement shall be recorded and thereafter the inquiry shall be held and completed within a period of 15 days.
Mr.Sutar for the petitioner orally submitted that the threat has been given by respondent as to why the complaint has been filed before this Court.
In view of the same, we direct that the respondent shall hold the inquiry in a fair manner, without giving any ill-treatment to the complainant or otherwise and shall examine the matter in accordance with law. The report shall be submitted on 5.12.2011. If the inquiry is not completed and the report is not submitted by the respondent - District Superintendent of Police before the next date, the respondent shall personally remain present before this Court on the next date. If the report is already submitted, he need not remain present.
