JUDGMENT / ORDER

~~~~~~~~~~~ Petitioner has filed this Writ Petition alleging that his wife is missing since 19.05.2014. He suspects that she was abducted by the 3rd respondent and on that basis he filed this Writ Petition praying for a writ of habeas corpus. In paragraph 4 of the Writ Petition, the petitioner has averred thus: “When the matter was informed by the father-in-law, this petitioner resigned his job on 19.05.2014 and reached his native place on 24.05.2014. It is respectfully submitted that this petitioner got reliable information that his wife had withdrawn an amount of Rs.3,00,000/- from his bank account and she had taken away all her gold ornaments and a huge amount of money with her. It is also submitted that in an earlier occasion this petitioner had got some information about his wife's relationship with the 3rd respondent while he was checking her e-mail account and the details of chatting. When this petitioner scolded his wife for that, she confessed that she will not make any further contacts with him in future. Now this petitioner is bonafidely doubting that the 3rd respondent might be enticed his wife by pretending love with an ill-motive to exploit her money and gold ornaments. He most respectfully submits that the 3rd W.P.(Crl) No.222/2014 2 respondent abducted his wife and is illegally detaining her in an unknown place.”
2. Reading of the above paragraph itself shows that even according to him the wife has deserted the petitioner voluntarily. We are therefore not satisfied that the case of the petitioner discloses a case of illegal detention of his wife justifying the entertainment of the Writ Petition with the prayer for a writ of habeas corpus. Hence, this Writ Petition is dismissed.
