Petition filed under Section 438 Cr.P.C. 2. According to the petitioner, he is apprehending arrest in connection with Crime No.99/2014 of Pathanapuram Excise Range, Kollam District. The said crime is registered under Sections 55(a) and 55B of the Abkari Act.
3. This is a case wherein 7000 Ltrs of Spirit, which was transported from Tamil Nadu to Kerala in a secret chamber of a lorry bearing Reg.No.TN 10 AA- 4957, was seized at 1.30 a.m. on 3.9.2014.
4. Heard the learned counsel for the petitioner and the learned Public Prosecutor. The learned Public Prosecutor has pointed out that so far the petitioner is not arraigned as an accused B.A.7837 of 2014 2 in the crime. At the same time, he is a suspect in the crime, as the statements of accused Nos.3, 4 and 5 have revealed the involvement of the petitioner. According to the Investigating Officer, he cannot say, at present, whether the petitioner is an accused or not, in the crime.
5. At any rate, this is not a fit case wherein anticipatory bail can be granted to the petitioner. The petitioner has to co-operate with the investigation.
In the result, this bail application is dismissed.
