JUDGMENT / ORDER

The petitioner purchased a Tempo Traveller passenger vehicle, which he sought to be registered as a Omni Bus, for private use. Though the tax was accepted by Exhibit P7, registration was refused, since it was not permitted at that point of time. However, later on, as per Exhibit P8 an amendment was brought into the Kerala Motor Vehicles Taxation Act, 1976, wherein a new category, by name “Caravan/Camping Trailor” was introduced and tax was levied for every square metre at the rate of Rs.1,000/-. The petitioner, hence, has sought for registration under the said provision and only seeks consideration of the said prayer. 2. The learned Government Pleader, on instructions, submits that if the vehicle is produced after modifications are made as per the Rules, the same shall be assessed to tax under the Taxation Act.

3. In the above circumstance, there shall be a direction to the petitioner to produce the vehicle before the competent authority, being the 1st respondent, within one week and the 1st respondent shall consider the request of the petitioner for registration of the vehicle as Non-Transport Caravan Vehicle and pass orders within a period of two weeks from that date.
Writ petition is disposed of as above. No costs.
