Challenge is made in this petition to the order of learned Chamber Judge, City Civil Court dated 22nd February 2011 setting aside the abatement, condoning delay in the application filed to join the heirs of the deceased defendants Nos. 3 and 5, relying on the decisions of the Apex Court in Madan Naik (dead by Lrs) and Ors Vs.
