This Criminal Misc. Application under Section 482 Cr.P.C. has been filed with the prayer to allow this application and to direct the court below to decide bail application of the applicant on the same on which he surrenders before the court below in Criminal Case No. 1509 of 2004, State Vs. Muneshwar Prasad Srivastava in case crime no. 700 of 1996, under Sections 419, 420, 467, 468, 470, 120B, 201 and 471 IPC, P.S. Colonelganj, District-Allahabad. Heard learned counsel for the applicant and learned A.G.A. and perused the record.
Learned counsel for the applicant submitted that co-accused has already been released on bail. The prayer is for consideration of the bail application, expeditiously, preferably on the same day. In view of the fact of the present case, it is provided that if applicant appears and surrenders before the court below and apply for bail within three weeks from today, then the prayer for bail shall be considered, as expeditiously as possible in accordance with law, in view of the law laid down by the Full Bench of this Court in the case of Amrawati and another Vs. State of U.P. reported in 2004(57) ALR 390 and affirmed by Hon. Apex Court in Lal Kamlendra Pratap Singh Vs. State of U.P. and others 2009(2) Crime 4 SC after affording the opportunity to the public prosecutor.
