Heard learned counsel for the petitioner and Shri B.B. Pandey, learned Addl. Chief Standing Counsel. Shri Manu Singh has accepted notice for Gaon Sabha.
In view of the order proposed to be passed, notices need not go to private respondent.
The petitioner is before this Court for a direction to second respondent to decide Case No.07 of 2016 (Saiyad Husain v. Sukhveer) under Section 38/39 L.R. Act within stipulated period.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue and with the consent, the writ petition stands disposed of finally with a direction to second respondent to consider and decide the aforesaid case in accordance with law expeditiously and preferably within a period of four months from the date of production of certified copy of this order but certainly after giving opportunity to the parties concerned and without granting unnecessary adjournments to either of the parties, except upon payment of cost.
