JUDGMENT / ORDER

The limited prayer in this original petition is for a direction to the Sub Court, Attingal to take up and dispose of O.S.No.75/2012 pending before the said court. 2. The suit was one for eviction and damages. The petitioners point out that the suit has been pending consideration for the last two years and issues have been raised and after that the case is not posted for trial and that is being adjourned from time to time.
3. The petitioners point out that the delay in disposing of the suit affects their rights and it causes irreparable loss and injury to them.
4. Even though the prayer may look innocuous, this Court knows that Sub Court, Attingal is a heavy court and issuing a direction to dispose of the suit of the year 2012 expeditiously may not be appropriate.

5. Considering the limited prayer made in this petition, it is felt that necessary directions can be issued.
This original petition is disposed of directing the Sub Court, Attingal to make every endeavour to take up O.S.No.75/2012 and dispose of it as expeditiously as possible.
