JUDGMENT / ORDER

Fortunately for this Court, it is not necessary to go the facts of the case for the simple reason that the parties have settled the matter between them and they have entered into a compromise. A sketch is also appended to the compromise petition whereby the parties have agreed to take the respective plots allotted to them. 2. After having heard the learned counsel on both sides and also after having gone through the compromise petition, this Court finds no reason to decline the relief on the basis of the compromise petition as it is not found contrary to law. The compromise petition is accepted. Consequently, the decree of the lower appellate court is set aside and a preliminary decree is passed on the following terms.
As per Annexure I, plots marked as I are to be allotted to respondents 1 to 4 herein, plots II to be allotted to respondents 5 and 6 herein, R.S.A No.501/2013 2 plots III to be allotted to the appellant herein and plot IV to be allotted to respondents 7 to 10 herein. The unnumbered plots in the sketch is the way for the ingress and egress to the plots I to IV which are to be allotted to the respective sharers.
There will be a further direction to the trial court to pass final decree in terms of the compromise and the sketch, a copy of which will be sent to the trial court. The compromise will form part of the final decree also. The parties will appear before the trial court on 26.06.2014 and the trial court shall dispose of the matter within a period of three weeks from the date of appearance.
