The prayer made in the instant petition is for issuing direction to the Executing Court to decide Execution Case No. 15 of 1995 expeditiously.
A perusal of the order sheet reveals that for considerable period, the proceedings of execution case remained stayed on account of the stay order by this court in First Appeal filed by the judgment debtor. The First Appeal is stated to have been dismissed on 17.8.2015. The said fact has also been noted by the Executing Court in its order passed on 26.3.2019.
Having regard to the same, the instant petition is disposed of with direction to the Executing Court to ensure speedy disposal of the proceedings by fixing short dates and without granting unnecessary adjournments, provided there is no legal impediment.
