This petition has been filed praying for expediting the SCC Suit No. 63 of 2017 (Smt. Sahjadi Begum Vs. Mohd. Naim) pending before the Judge Small Causes Court, Kanpur Nagar within the stipulated time period.
Learned counsel for the petitioner submits that the Small Causes Court is unnecessarily giving time to the tenant in the SCC Suit filed by the petitioner praying for arrears of rent and eviction of the tenant under Section 20 of U.P. Act No. 13 of 1972. For the past one year, written statement has not been filed by the tenant. This Court may expedite the matter.
Looking into the facts and circumstances of the case, no direction can be issued to the learned Court below to decide the aforesaid case within the stipulated time period.
However, the learned Court below shall keep in mind that if written statement is not filed by the tenant within a period of two months, then it shall proceed ex-parte in the matter and deliver judgment as early as possible.
The petition is disposed of.
