Heard learned counsel for the parties and perused the record.
By way of instant bail application, prayer has been made to enlarge the applicant on bail in Case Crime No. 265 of 2018, under Sections 147, 148, 149, 323, 504, 506 and 302 of the Indian Penal Code, 1860 Police Station - Achhnera, District - Agra.
Learned counsel for the applicant contended that co-accused Banwari has been declared juvenile and role of causing injury by 'fadwaa' to Jaspal, brother of informant is assigned to Banwari, due to which Jaspal died. Role of the applicant is similar to that of co-accused Charan Singh, Girdhari alias Himanshu and Himmat Singh, who have already been admitted to bail vide orders of this Court passed in Criminal Misc. Bail Application No. 40296 of 2018 (Himmat Singh v. State of U.P.) dated 24.10.2018 and in Criminal Misc. Bail Application No. 34167 of 2018 (Girdhari alias Himanshu) connected with Criminal Misc. Bail Application No. 36385 of 2018 (Charan Singh v. State of U.P.) dated 31.10.2018. Case of the applicant, therefore, is on the same footing as that of the abovementioned co-accused who have been enlarged on bail.
Without commenting on the merits of the case, considering the facts and circumstances of the case, I find it a fit case for enlarging the applicant on bail.
In view of above, the prayer so made is accepted and accordingly, the instant application stands allowed.
Let the applicant - Sahiram be released on bail in the aforesaid case crime number on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the court concerned.
