1. Heard Sri Amit, learned counsel for petitioner; and, Sri H.N. Tripathi, learned counsel for respondent-2 and learned Standing Counsel for State.
2. It is said that clearance/no objection certificate was obtained by respondent-5 for running of brick kiln from Pollution Control Board is cancelled but the same has not been enforced and still respondent-5 is running brick kiln.
3. However, it has come on record that respondent-5 challenged cancellation order in a writ petition wherein the said order has been quashed and this fact is admitted by counsel for petitioner. That being so, mandamus as sought for in the present writ petition, cannot be issued.
4. Pursuant to this Court's order dated 05.04.2019, petitioner was directed to pay a fee of Rs. 25,000/- to Advocate Commissioner and counsel for petitioner informed that he has already paid Rs. 10,000/- to him and remaining amount would be paid within a week. Let him do so.
5. In view thereof, writ petition is accordingly dismissed.
