Heard learned counsel for the petitioners. The relief sought in this petition is for quashing the FIR registered as case crime no.501 of 2009 under Sections 363 and 366 IPC, Police Station Debai, district Bulandshahr.
Learned counsel for the petitioner submitted that the petitioner no.1 Sahin Begam alias Bhawna Varshney is major and she married with petitioner no.2 Naved alias Mohd. Mazid Ali @ Banti out of her own sweet-will. It is further submitted by learned counsel for the petitioners that Sahin Begam alias Bhawna Varshney and Naved alias Mohd. Mazid Ali @ Banti are present in the Court.
The petitioners are directed to produce Sahin Begam alias Bhawna Varshney before the concerned Magistrate within 15 days. The Magistrate concerned shall get Sahin Begam alias Bhawna Varshney medically examined to ascertain her age. He shall also record her statement under Section 164 Cr.P.C after intimation to the complainant.
The arrest of the petitioners is stayed for a period of one month. It shall not be treated as tied up or part heard with this Bench and shall stand released from the order of assignment.
