THE HON’BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.29075 of 2014 ORDER :
This writ petition is filed for correction of date of birth of the petitioner in the passport. An application was submitted by the petitioner which was acknowledged by the Regional Passport Office on 27.04.2014. The grievance of the petitioner in instituting this writ petition is so far no orders are passed carrying out the said correction in the passport.

Learned Counsel for the petitioner submits that at the time passport was obtained in the year 2009, the petitioner was a minor and therefore he was not aware as to how a declaration was to be made regarding his age. The petitioner passed his S.S.C., in March, 2012. The certificate issued by the Board of Secondary Education, discloses the date of birth of the petitioner as 04.07.1995, whereas in the passport it was recorded as 04.07.1994. The date of birth issued by the competent authority also discloses the correct date of birth as 04.07.1995. The delay on the part of the respondent in not acting upon the representation of the petitioner is erroneous. He also placed reliance on two decisions of this Court in W.P.No.451 of 2004 and W.P.No.22950 of 2010 concerning the same issue.

Having regard to the said submissions, without expressing any opinion on merits the writ petition is disposed of directing the respondent Passport authority to consider the request of the petitioner for correction of the entry of date of birth by duly taking note of the certificates now submitted by the petitioner and pass appropriate orders as warranted by law, and communicate the decision within a period of three weeks from the date of receipt of a copy of this order. There shall be no order as to costs.
4. Miscellaneous petitions, if any, pending in this writ petition, shall stand closed.
