The accused in C.C.No.543 of 2011 of the Judicial First Class Magistrate's Court-I, Hosdurg and the defacto complainant in it as petitioners, have come up under Section 482 Cr.P.C. for getting Annexure I Final Report and proceedings in C.C.No.543 of 2011, quashed. 2. Initially, the case was registered as Crime No.162 of 2011 of the Chandera Police Station for the offences under Section 498A IPC read with Section 34 IPC. The crime was registered on the basis of a private complaint filed by the defacto complainant, who is the 3rd petitioner herein, before the Judicial First Class Magistrate's Court-I, Hosdurg, which was referred to the Police under Section 156(3) Cr.P.C.

After investigation, the Police has filed Annexure I Final Report before the court below and presently the matter is pending as C.C.No.543 of 2011.
3. According to the petitioners, they have amicably settled the matter and presently there are no disputes between them. According to the 3rd petitioner, she has no complaints against the petitioners 1 and 2 as the matter has been amicably settled. The 3rd petitioner has filed an affidavit stating that the matter has been amicably settled and therefore, she does not want to proceed with the case in C.C.No.543 of 2011. The investigating officer has also enquired about it and he has filed a report stating that the parties do not want to proceed with the matter and they have decided to live together. When the matrimonial offence involved is amicably settled between the parties, there is no reason to deny the present request for getting the proceedings in the criminal case, quashed.
In the result, this Crl.M.C. is allowed and Annexure I Final Report as against the petitioners 1 and 2 and all Crl.M.C.No.6523/2014 : 3 :
further proceedings in C.C.No.543 of 2011 of the Judicial First Class Magistrate's Court-I, Hosdurg are hereby quashed.
