A regular civil appeal under Section 96 CPC has been decided by impugned judgement dated 15.12.2017.
In the opinion of the Court, the petitioner has remedy to assail the said judgment under the provisions of Code of Civil Procedure itself. In such view of the matter, this Court is not inclined to entertain the instant petition filed under Article 227 of the Constitution.
The petition is dismissed with liberty to avail the remedy provided under the Code.
Certified copies of the order shall be returned to the counsel for the petitioner, in case an application in that regard is moved, after retaining photostat copy on record.
