Learned APP, waives service of rule on behalf of respondent.
2. Heard learned advocate for the parties.
3. The application preferred by the applicant before the Competent Court to get the condition modified of return of the passport for renewal is rejected on the ground that conditions were imposed by the High Court while granting anticipatory bail to the applicant.
4. Considering the requirement as stated in the application, I am inclined to allow it by directing the Court below to return the passport to the applicant for the purpose of renewal and after renewal is granted such passport be deposited in the Court.
5. With the aforesaid, the condition No.(e) passed vide order dated 18.8.2011 in Criminal Misc. Application No. 10996 of 2011 is temporarily modified.
6. With the above, this application is disposed of. Rule is made absolute to the above extent. Direct service is permitted.
