Heard Sri P.S. Chauhan, learned counsel for the petitioner and Sri Pradeep Kumar Tripathi, learned Standing Counsel for the State-respondent.
Petitioner by the instant writ petition, primarily, seeks a direction to the second respondent, District Collector/District Mining Officer, Saharanpur, to consider and decide the objections dated 10 march 2018 submitted by the petitioner assailing the e-auction of mining lease in respect of Ninuyari Ghat, District Saharanpur.
Pursuant to the policy of the Government bids through e-tender was invited online by notification/advertisement dated 20 January 2018. Petitioner participated and upon successfully qualifying the first round was shortlisted along with four others to participate in the second round of bid.
It is contended that petitioner had initially bid at Rs. 806 per cubic meter and, thereafter, enhanced the bid at Rs. 808 per cubic meter, however, the bid was finalized in favour of the fourth respondent at Rs. 807 per cubic meter.
Learned Standing Counsel, on instructions, submits that petitioner had not submitted the bid at Rs. 808 per cubic meter, the allegation of the petitioner that MSTC site was hacked, consequently, petitioner could not bid any further, is not borne out from the record.
On specific query, learned counsel for the petitioner was unable to show (time) from the material brought on record as to when did the petitioner bid at Rs. 808 per cubic meter as against the bid at Rs. 807 per cubic meter which was tendered at 2.14 P.M.
In the circumstances, we do not find any merit in the writ petition.
Accordingly, the writ petition is dismissed.
